Refund Policy

In anticipation of being allowed to enroll and participate in training events, herein known as "services" or "training services" offered by Respond1st LLC, herein known as the "company", the participant, herein known as the "student" or "enrollee" agree to the following standards:

SECTION 1 - ENROLLMENT TERMS & CONDITIONS

1.1: Enrollment Acceptance & Receipt:

The company accepts enrollments for services primarily through our online registration portal, CORE, or the Consolidated Online Registration Engine. Alternatively, prospective students may enroll for a posted training event by phone or in person at our office. For alternate enrollments, students should be prepared to make payment, in full, via a valid debit or credit card at the time of registration. The company does not accept cash for in-person enrollments or on-site payments. Additionally, the company does not allow on-site enrollments for events being held the same day. Regardless of how the student enrolls, the student agrees to be bound by all terms, conditions, and applicable guidelines related to the enrollment and the selected service. The student further agrees that the decision to enroll and participate in the service is voluntarily and of their own free will. Additionally, the student consents to receiving electronic communications related to the enrollment/service which could take the form of email, text (SMS) message, or automated phone call, or a combination of each. The company accepts all enrollments conditionally, subject to verification and confirmation. Upon confirmation, the student will receive a welcome email from the company indicating the same is confirmed. In contrast, if the company does not accept an enrollment, notification will be made via email.

1.2: Third-Party Advertising Vendor(s):

The company, from time to time, may use third-party advertising vendors to help promote visibility of the company’s service offerings. Such vendors often provide prospective students with the ability to inquire, reserve, or "register" for advertised services. Such inquiries are not an official enrollment to the company and will not be accepted as such. The prospective student will be requested to submit an official enrollment for the selected service via the acceptable enrollment methods outlined in the section “01: Enrollment Terms & Conditions”.

1.3: Enrollment Modifications:

Students may opt to modify an active enrollment within their discretion. Modification requests MUST be received by the company twenty-four (24) hours or more in advance of the enrolled event start date. The company will ONLY honor requests submitted by phone with a live company representative or via the operations email (service@respond1st.com). Requests submitted or received through any other channel(s) will not be honored. Modification options are as follows:

  • Reschedule: *Rescheduling Service Fee - $15.00*

    A reschedule, also known as a transfer, moves a confirmed enrollment from the original scheduled date & time to a new date & time AND to a service matching the same type, category, & cost of the initial enrollment.     A Rescheduling Service Fee is imposed on all transferred enrollments, apart from those for services built under CustomAccess Training Administration Program (TAP). Regardless of the build of a service, a limit of     two (2) transfers on any one enrollment is strictly enforced.

  • Cancellation: *Cancellation Service Fee - $25.00*

    A cancellation, also known as a termination, ends an active enrollment and effectively withdraws the student from the enrolled service. A Cancellation Service Fee is imposed on all     terminated enrollments. This fee will be withheld from any amounts due to be refunded, if applicable. A Materials Fee, equal to the amount of materials which have been issued/allocated,     may also be imposed for terminations occurring within forty-eight (48) hours of the event’s start date.

1.4: Provider Recall:

If the company, regardless of reason or circumstance, recalls a scheduled training event for the purpose of cancelling, rescheduling, or rebuilding thereby making the service unavailable to the student, the same will have the option to execute one of the modifications mentioned in section 1.3 Enrollment Modifications, without penalty. The student will also have the additional option to receive company credit for all fees paid. Company credit is subject to the Company Credit Issuance & Use Policy.

1.5: Disclaimer of Warranties/Guarantees:

Services are offered "as is" and "as available". The company make no representation or warranty of any kind whatsoever to the student or any other person(s) relating in any way to the services, including any part thereof, or any website, interface, or 2, software that may be accessible directly or indirectly throughout the services. The company reserves the right to discontinue any product or service, at its discretion, with or without advance notification.

SECTION 2 - PARTICIPATION TERMS AND CONDITIONS

2.1: Event Arrival & Check In:

It is the responsibility of the student to show up as scheduled, actively engage and participate in the activities of the event and remain on site for the duration of the event or until dismissed by the Instructor/Course Director, herein known as the "contractor" to increase chances of success. Students are expected to arrive at the training site on time, (or no more than fifteen (15) minutes early) and prepared to attend the event. Students arriving late or departing early are subject to the following conditions:

  • Late Arrival(s):

    Students arriving fifteen (15) or more minutes late to a training event will be denied admission, unless exempted due to an extenuating circumstance(s), and required to reschedule, at the     student’s expense. Students arriving between one (1) and fourteen (14) minutes late may be allowed admission at the discretion of the contractor. Reschedules for late arrivals will be     handled according to the terms outlined in section 1.3 "Enrollment Modifications".

  • Early Departure(s):

    Students departing thirty (30) or more minutes early, or before being dismissed, will receive a completion status of “Incomplete” and will be required to schedule a Continuation Session, at the student’s expense,     within seven (7) business days from the date of service. Continuation Session(s) are available in two (2) hour increments at the current Hourly Instructional Rate. Continuation Sessions are ineligible for rescheduling     and students failing to complete this session within the allotted time frame will have their completion status changed to “Unsuccessful”. This action is final.

2.2: Student Check-In

Upon arrival, students will check-in for the event they are attending. Check-in will verify, as a standard, the student’s identity, preparedness to attend, and proof of purchase. Additionally, students may be required to verify additional items including, but not limited to, proof of course/certification eligibility and, in some instances, provide payment for additional charges. Students unable to complete the check-in process successfully may be denied admission into the event. Failed check-in will be handled as follows:

  • Non-Compliant Check-In:

    Students failing to provide positive proof of identity, proof of preparedness and/or proof of purchase, will be denied admission into the event and required to reschedule, at the student’s     expense. If applicable, the company will present all options to comply with the check-in process on site, at the time of check-in. If satisfied, the process will continue as normal. Reschedules     will be handled according to section 1.3: Enrollment Modifications.

2.3: Enrollment Abandonment:

The company considers abandoned enrollment(s), or "No-Show’s", an Adverse Action Event (AAE) presenting a significant negative impact to the company and the service. A student is considered to have abandoned his/her enrollment if the student has not checked-in within thirty (30) minutes and a request to modify an enrollment has not been submitted OR student fails to fulfill a Completion Deferment. The student will be recorded as a “No-Show’ and subject to the conditions below.

  • Student No-Show:

    Students that No-Show FORFEIT ALL MONIES PAID AND RIGHTS UNDER THIS POLICY. Additionally, and at the discretion of the company, the students’ account may be converted to a "secured “or “restricted” account     affecting the student’s ability to secure services in the future. All accounts with recorded No-Shows will have future purchases accepted “in reservation” with the company maintaining the right to return, or reject,     the same without cause.

  • The terms of a Deferment Expiration are explained, in depth, under section 2C. Incomplete Status.

The company will consider only bonafide and verifiable extenuating circumstances as an exception toa recorded abandonment.

2C. Incomplete Status:

Any student that is admitted into a service but does not complete the service may be assigned “Incomplete" as a temporary completion status. As incomplete is not a final status, the student will be required to schedule, at his/her expense, a continuation/remediation session within seven (7) business days, subject to the availability of the assigned contractor. This is known as Completion Deferment and is a one-time action automatically issued to any student recorded as incomplete. A Completion Deferment may be issued only once per certification cycle unless a bonafide and verifiable extenuating circumstance exists. A continuation/remediation session will incur a cost equal to the current Hourly Instructional Rate, purchasable in two (2) hour blocks. Regardless of the circumstance, an incomplete status is required to be converted to a final status within ten (10) business days of the action date. Students that have not scheduled and/or attended the required continuation/remediation session within the ten (10) business day limit will be considered to have abandoned their Completion Deferment by allowing the deferment to expire.

  • Completion Deferment Expiration:

    A Deferment Expiration, also known as completion abandonment, occurs when a student in an incomplete status fails to either schedule and/or attend a required continuation/remediation session within the allotted     time frame. If the student allows his/her deferment to expire, the completion status will convert to a status of "Fail" and the enrollment will be considered a "No-Show" and handled according to the "No-Show" clause     under section 2B. Enrollment Abandonment.

2C. General Standard(s) of Conduct:

All students participating in services offered by the company are expected to conduct themselves in a manner that exudes courtesy and respect to everyone in attendance. To ensure a meaningful and pleasant experience, the student will comply with the General Standards of Conduct for the entirety of the encounter. Students will follow all directions always given by the contractor, and interact professionally with the contractor, participants and others who may be on site. Additionally, the student will obey all community guidelines, along with local, state, and federal law while in attendance. Consuming illegal substances and/or engaging in illegal activities is strictly and expressly prohibited on all sites operated by the company to include outdoor spaces and personally occupied vehicles that are on company owned, leased, or operated property.

The student acknowledges the responsibility to learn and be successful within the registered event is the sole responsibility of the student and the company does not offer refunds, of any kind, to students that do not complete the event successfully. The company’s staff and contractors retain full authority over the event to which they are directing. Should a student fail to obey the directives of the contractor, becomes disrespectful or unruly towards company staff and/or other participants on site or present a threat to the wellbeing and/or personal safety of the contractor or those in attendance, the student in violation may be demanded to leave the premises at once

  • Forced Dismissal: *FORFEITURE OF MONIES PAID & RIGHTS BESTOWED*

A demand to exit the premises because of unruly behavior is known as a Forced Dismissal. If a student is dismissed by force, he/she will be required to leave the site immediately and an immediate, but temporary, ban of the student from all company operated facilities and sites will be imposed. After a thorough review of the incident, the student may also be registered to the companies Excluded Client List (ECL) and appear temporarily or indefinitely. Students registered with the ECL become ineligible to purchase, attend or otherwise benefit from all products and services offered by the company. The company, at its discretion and after a thorough review of the incident, will determine how to best handle any student who was unable to successfully complete the training event while considering the safety and security of contractors, staff and other participants/bystanders. In the event Law Enforcement assistance is needed in the execution of a forced dismissal, the student will be recorded as a Fail status and be registered to the companies Excluded Client List indefinitely.

2D. Failure to Succeed

Students, despite several attempts, that are unsuccessful in completing the requirements of training event to which they are registered will be recorded as a "Fail" status and be ineligible to receive any associated certification, certificate of completion or other formal completion verification documents. This status is final and is not eligible for appeal or to be overturned. So long as the student has not violated any other part of this policy, the student will have the option to re-enroll in the training event and re-attend the course in anticipation of being successful in the re-attempt(s). In accordance with our Refund Policy, refunds are not issued for services provided, regardless of completion status. We encourage potential students to utilize our Training Advisement service to assist in being adequately prepared for training events hosted by the company. This service is offered free of cost to all clients of the company and can prove to be an invaluable resource for students attending training services for the first time and/or those with known intellectual or learning challenges
