East Coast Safety Consulting Terms and Conditions and Student Enrollment Agreement

These Terms and Conditions and Student Enrollment Agreement govern the use of the East Coast Safety Consulting website and registration for, attendance at, and participation in courses offered by East Coast Safety Consulting, LLC, referred to below as “East Coast Safety Consulting,” “ECSC,” “we,” “us,” or “our.”

By accessing this website, purchasing a product or service, registering for a course, or attending training, you acknowledge that you have read, understood, and agreed to these terms.

1. Website Use and Acceptance of Terms

By accessing or using this website, you agree to comply with these Terms and Conditions and all applicable laws and regulations. If you do not agree with these terms, you should not use the website, register for training, or purchase products or services through it.

We may revise these terms periodically. Continued use of the website or our services after revisions are posted constitutes acceptance of the updated terms.

2. Website Materials and Limited License

Permission is granted to temporarily view or download one copy of website materials for personal, noncommercial use only.

Unless written permission is provided by East Coast Safety Consulting, users may not:

  • Copy, reproduce, republish, or distribute website materials;

  • Modify or create derivative works from website content;

  • Use the materials for commercial purposes;

  • Remove copyright, trademark, or proprietary notices; or

  • Attempt to reverse-engineer software or systems used by the website.

This limited permission may be revoked at any time.

3. Website Disclaimer

Website materials are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, East Coast Safety Consulting makes no express or implied warranties regarding the accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, or noninfringement of website content.

Information on this website is provided for general informational purposes and is not a substitute for completing an approved certification course or obtaining professional medical, legal, regulatory, or workplace-safety advice.

4. Registration and Payment

Course registration is not guaranteed until East Coast Safety Consulting receives full payment or any required deposit.

Students are responsible for:

  • Selecting the correct course;

  • Confirming that the course meets their employer, licensing, regulatory, or certification requirements;

  • Completing required prerequisites before class;

  • Providing accurate registration information; and

  • Bringing required identification, certification cards, manuals, or other course materials.

Course prices, dates, instructors, locations, and availability are subject to change.

5. Attendance and Punctuality

Students should arrive at least 10 minutes before the scheduled class time. Courses begin promptly, and students who arrive after instruction has begun may not be admitted.

A student who is denied entry because of a first late arrival may be offered one courtesy rescheduling opportunity. Additional late arrivals may be treated as late cancellations and may result in forfeiture of tuition.

Students must attend the entire course, participate actively, and complete all required written examinations, practical exercises, and skills evaluations. Attendance by itself does not guarantee successful completion or certification.

6. BLS Renewal Eligibility

The discounted BLS Renewal course is available only to students who currently hold a valid, unexpired American Heart Association BLS Provider certification.

Students must present proof of an eligible certification at class. A student registered at the renewal rate who cannot provide a valid American Heart Association BLS Provider card will be required to pay an additional $15 to remain enrolled.

East Coast Safety Consulting does not guarantee that a certification issued by another organization, training provider, or program will qualify a student for the renewal rate.

7. Complimentary BLS Skills Refresher

Students who previously completed an American Heart Association BLS Provider course through East Coast Safety Consulting at our South Plainfield location may attend a scheduled BLS class for complimentary skills practice when they hold a current, valid East Coast Safety Consulting certification card.

To request a refresher seat, students must text 908-801-9168 or email info@eastcoastsafetyconsulting.com with their:

  • Name;

  • Original certification date; and

  • Preferred class date.

Participation is subject to available seating and instructor approval. The refresher is for skills practice only and does not include a new certification card, renewal, course-completion credit, or continuing-education credit.

8. Required Course Materials

The American Heart Association, American Red Cross, and other certifying organizations may require each student to possess the applicable provider manual or course materials.

When required, students will be given an opportunity during registration to purchase or access the appropriate material. Students are responsible for obtaining and bringing the correct materials to class.

A student who arrives without required course materials may be required to purchase them before participating. Failure to obtain required materials may prevent participation and will not automatically entitle the student to a refund.

9. Cancellation and Rescheduling

Students who provide at least 24 hours’ notice may reschedule once without an additional fee.

Requests to reschedule made fewer than 24 hours before the scheduled class are subject to a $25 rescheduling fee.

Students who fail to attend without four (4) hours notice will forfeit all tuition, deposits, and other payments. Payments associated with late cancellations and no-shows are nonrefundable and nontransferable.

A courtesy rescheduling opportunity does not create a right to additional rescheduling. After a student has rescheduled once, future changes will result in a $25 rescheduling fee.

10. Class Cancellations by East Coast Safety Consulting

Refunds are issued only when East Coast Safety Consulting cancels a course and does not provide an acceptable rescheduling option.

When a class is postponed or canceled because of severe weather, instructor illness, facility problems, low enrollment, emergencies, or circumstances beyond our reasonable control, affected students may be transferred to a future class.

East Coast Safety Consulting is not responsible for incidental expenses resulting from a cancellation or schedule change, including transportation, lodging, childcare, lost wages, or time away from work.

11. Student Conduct

East Coast Safety Consulting is committed to maintaining a safe, respectful, and professional learning environment.

Students may be removed from class when they:

  • Appear to be under the influence of alcohol or drugs;

  • Engage in abusive, threatening, discriminatory, disruptive, or unsafe behavior;

  • Harass an instructor or another participant;

  • Refuse to follow reasonable instructor directions;

  • Cheat or falsify course information;

  • Intentionally damage equipment or property; or

  • Interfere with the ability of others to learn.

A student removed for misconduct may be denied certification and will not receive a refund.

12. Certification and Course Completion

Certification cards and course-completion documentation are issued only after the student successfully satisfies every requirement established by East Coast Safety Consulting and the applicable certifying organization.

Requirements may include:

  • Full attendance;

  • Successful skills demonstrations;

  • Participation in scenarios;

  • Passing written examinations;

  • Completion of online coursework;

  • Verification of prerequisites; and

  • Compliance with instructor directions.

Instructors cannot waive, modify, or disregard certification standards. East Coast Safety Consulting does not guarantee that every participant will pass or receive certification.

Students are responsible for ensuring that their name and email address are entered correctly. Fees may apply when a certification card must be corrected or reissued because the student supplied inaccurate information.

13. Medical and Physical Considerations

CPR, First Aid, AED, BLS, lifeguarding, and related courses involve physical activity. Activities may include kneeling, bending, lifting, performing chest compressions, providing simulated rescue breaths, moving equipment, and participating in practical scenarios.

By participating, students represent that they are physically capable of completing the required activities or that they have informed the instructor of relevant limitations before class begins.

Students should consult an appropriate healthcare professional before participating when they have concerns about their ability to perform course activities. East Coast Safety Consulting may make reasonable instructional accommodations when permitted by the certifying organization, but it cannot waive required skills or performance standards.

14. Assumption of Risk

Students acknowledge that hands-on training involves foreseeable risks, including physical discomfort, fatigue, muscle soreness, minor bruising, strains, falls, contact with training equipment, and other minor injuries.

By participating, students voluntarily accept the ordinary risks associated with the course and agree to follow safety instructions, use equipment appropriately, and immediately report injuries or unsafe conditions to the instructor.

15. Release of Liability

To the fullest extent permitted by applicable law, each participant releases and holds harmless East Coast Safety Consulting, its owners, members, employees, instructors, contractors, affiliates, representatives, and agents from claims arising from the ordinary and inherent risks of voluntary participation in training.

This provision is not intended to waive liability that cannot lawfully be waived, including liability resulting from gross negligence, reckless conduct, intentional misconduct, or other conduct for which a release is prohibited by applicable law.

Liability waivers can be restricted or interpreted differently depending on the state and the circumstances, particularly when physical injuries or allegations of gross negligence are involved. This provision should therefore be reviewed by an attorney licensed in each state where ECSC regularly conducts training.

16. Photography, Video, and Security Cameras

East Coast Safety Consulting may occasionally photograph or record classes for educational, operational, or promotional purposes.

By attending, students grant East Coast Safety Consulting permission to use their image or likeness unless they provide written notice to the instructor before class begins.

Some classrooms or training facilities may use security cameras. Notices may be displayed at the entrance or inside the facility. Students who are concerned about security-camera recording should ask the instructor or facility representative before entering the classroom.

Security recordings are controlled by the party operating the applicable camera system and may be retained or disclosed as permitted by law.

17. Online Courses and Technology

Students enrolled in online or blended-learning courses are responsible for having compatible equipment, reliable internet access, a working email address, and the ability to access required learning platforms.

East Coast Safety Consulting is not responsible for interruptions caused by a student’s internet connection, device, browser, email settings, employer firewall, or failure to complete online assignments by the applicable deadline.

Sharing accounts, course access, passwords, tests, certificates, or copyrighted course materials is prohibited.

18. Products and Shipping

Product descriptions, images, availability, and pricing may change without notice. East Coast Safety Consulting does not guarantee that website images will precisely represent the color or appearance of a physical item.

Products are not shipped unless shipping is specifically offered or authorized as part of the transaction. Customers are responsible for providing a complete and accurate delivery address.

Any product return or exchange is subject to the applicable return policy displayed at the time of purchase.

19. Third-Party Services and Links

The website may link to registration systems, payment processors, learning platforms, certification organizations, or other third-party websites.

East Coast Safety Consulting does not control and is not responsible for the content, security, privacy practices, availability, or separate terms of third-party services. Use of those services may be subject to additional agreements.

20. Intellectual Property

Website content, course descriptions, business materials, graphics, photographs, videos, logos, downloadable resources, and original instructional materials are owned by or licensed to East Coast Safety Consulting and are protected by applicable intellectual-property laws.

The names, logos, course materials, and trademarks of the American Heart Association, American Red Cross, OSHA-authorized providers, and other organizations remain the property of their respective owners.

Registration for a course does not grant permission to reproduce, record, distribute, sell, upload, or publicly display course content or materials.

21. Website and Service Limitations

To the fullest extent permitted by law, East Coast Safety Consulting and its suppliers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from:

  • Use of or inability to use the website;

  • Loss of data or profits;

  • Business interruption;

  • Website errors or interruptions;

  • Third-party platforms;

  • Course scheduling changes; or

  • Reliance on general website information.

Some jurisdictions do not permit certain limitations, so these restrictions apply only to the extent legally enforceable.

22. Limitation of Liability

To the fullest extent permitted by applicable law, East Coast Safety Consulting’s total liability arising from a student’s registration, purchase, website use, or course participation will not exceed the amount paid by that person for the specific course, service, or product giving rise to the claim.

This limitation does not apply where prohibited by law or to claims involving gross negligence, reckless conduct, intentional misconduct, or other liability that cannot legally be limited.

23. Indemnification

To the extent permitted by law, users and students agree to indemnify and hold harmless East Coast Safety Consulting and its owners, employees, instructors, contractors, and representatives from claims, damages, costs, and reasonable legal expenses arising from:

  • Their unlawful use of the website;

  • Their violation of these terms;

  • Their unauthorized use or distribution of course materials;

  • Information they knowingly provide that is false or misleading; or

  • Damage they intentionally cause to people, facilities, or equipment.

24. Severability

If any provision of these terms is found invalid, unlawful, or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

25. No Waiver

A failure by East Coast Safety Consulting to enforce a provision does not waive its right to enforce that provision later.

26. Governing Law and Venue

These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except where another state’s mandatory law applies.

Any legal proceeding relating to these terms shall be brought in a court of competent jurisdiction located in New Jersey unless applicable law requires another venue.

Because ECSC provides services in multiple states, an attorney should confirm whether this governing-law and venue provision is suitable for registrations occurring outside New Jersey.

27. Electronic Acceptance and Signature

By checking an acceptance box, clicking a registration or purchase button, submitting payment, or otherwise completing registration, the user confirms that:

  • The information provided is accurate;

  • The user has reviewed these terms;

  • The user agrees to be legally bound by them; and

  • The electronic action serves as the user’s signature.

Federal law generally recognizes electronic records and signatures when applicable legal requirements are satisfied, although the registration process and retained records should be configured appropriately.

When registering a minor, the parent or legal guardian completing the registration accepts these terms for themselves and on behalf of the minor, to the extent permitted by law.
