Peace of Mind Training (POMT) – Student Terms & Conditions Agreement
Parties: Peace of Mind Training Corp. (“POMT”) and student (“Student”).
1. Training Standards
Student agrees to participate fully in all training sessions, adhere to instructor guidance, and uphold POMT's safety-first standards as outlined in POMT’s training policy manual.
POMT reserves the right, in its sole discretion, to remove any student who disrupts instruction, disrespects staff or peers, or jeopardizes safety. Removal may occur without refund.
2. Certification & Course Completion
Certification is contingent upon successful completion of all required skills, assessments, and attendance criteria. Completion of a course alone does not guarantee certification if performance standards are not met, as determined by the instructor or certifying body.
3. Liability & Assumption of Risk
Student acknowledges that CPR, AED, First Aid, and related training involve physical activity and simulated scenarios. Student voluntarily assumes all risks associated with participation and agrees to release POMT, its instructors, and affiliates from liability for any injuries sustained during training, except in cases of proven gross negligence, to the extent permitted by law. If the student is under 18, a parent or legal guardian must provide written consent.
4. Equipment & Materials
All training equipment remains the property of POMT unless otherwise specified. Students agree to treat manikins, AED trainers, and all materials with care and comply with hygiene and usage protocols.
5. Code of Conduct
Respect toward instructors, fellow students, and the training environment is required at all times. Use of discriminatory, aggressive, or disruptive language or behavior will result in immediate removal from the training program, without refund and at POMT’s sole discretion.
6. Media & Recording Consent
Student grants POMT the right to photograph, film, or record training sessions for educational or promotional use, unless a written opt-out request is submitted prior to the start of training. Such requests may be submitted by email or in person.
7. Payment & Refund Policy
All training fees must be paid in full before or at the start of training unless other arrangements have been made in writing. Refunds are granted solely at POMT’s discretion in cases such as course cancellation or verified medical emergencies. Documentation may be required.
8. Confidentiality & Integrity
Student agrees not to share or reproduce any testing materials, proprietary training content, or copyrighted resources obtained during the course. Violation may result in denial of certification and potential legal action.
9. Governing Law
This Agreement shall be governed by and interpreted under the laws of the State of New York, without regard to conflict of law principles. All disputes shall first be submitted to mediation in that state. If unresolved, disputes shall proceed to binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
